By using Drumatica.com, you acknowledge that your information will be handled as described in this Privacy Policy, subject to your rights and choices under applicable law.

Purchases and Product Fulfillment

We use information to process and document orders, confirm purchases, deliver digital products, administer software licenses and product entitlements, and maintain appropriate transaction records.

We use registration information to identify customers and products, validate ownership, register or activate Drumatica software, maintain license records, and help protect legitimate customers and Drumatica intellectual property.

Where permitted by applicable law and consistent with applicable customer choices, we may use information to communicate about:

Customers may opt out of promotional email communications as described below.

Analytics and Business Improvement

We may use information to understand how customers discover and use Drumatica.com, evaluate product and website performance, measure marketing effectiveness, understand customer interests, improve existing products, and develop new products and services.

Subject to applicable law, appropriate disclosures, and customer privacy choices, we may use certain information to:

  • Advertise Drumatica products

  • Understand whether advertising resulted in visits or purchases
  • Exclude existing customers from advertising for products they already own

3. Product Registration and Purchases Through Third-Party Retailers

Some Drumatica® products may be purchased through authorized third-party retailers or distributors rather than directly from Drumatica.com.

A customer who purchases a Drumatica product from a third-party retailer may subsequently visit Drumatica.com to register or activate that product.

During registration, we may request information such as:

  • Name
  • Email address
  • Drumatica product purchased
  • Retailer or distributor from which it was purchased
  • Product serial number
  • Telephone number, when voluntarily provided

This information may be used to verify ownership, administer software licenses, provide priority or technical support, maintain product-registration records, and communicate important information concerning the customer's Drumatica software.

When a customer provides information directly to Drumatica through our registration or activation process, Imaginos LLC receives and maintains that information independently of the retailer through which the original purchase occurred.

Where permitted by applicable law and consistent with applicable notices and customer choices, we may also communicate information about related Drumatica products, upgrades, releases, news, and special offers.

Third-party retailers and distributors maintain their own privacy practices. Imaginos LLC is not responsible for information those businesses collect independently under their own privacy policies.

4. Online Store, Payments, and Digital Product Delivery

Drumatica.com uses third-party ecommerce and technology providers to operate our online store and deliver our products.

Our ecommerce store is powered by Shopify. Shopify processes certain information in connection with purchases, store operation, security, analytics, and other ecommerce services.

Payment information is processed through the applicable payment processors. Imaginos LLC receives transaction information necessary to process and administer purchases but generally does not need to receive or store complete payment-card numbers.

Drumatica also uses digital-product delivery, licensing, and related technology services, including Filemonk where applicable, to deliver purchased files and administer product access.

These providers may process information necessary to perform services for Imaginos LLC and our customers.

5. Email and Customer Communications

Drumatica uses email to communicate with customers, registered product owners, and individuals who have chosen to receive Drumatica communications.

We may send transactional or service-related communications regarding:

  • Purchases and order confirmations
  • Product downloads and delivery
  • Product registration or activation
  • Software licenses
  • Software and product updates
  • Compatibility or technical information
  • Customer support
  • Security or account-related matters

Where permitted by applicable law and consistent with applicable customer choices, we may also send marketing and promotional emails concerning Drumatica products, upgrades, new releases, related products, discounts, special offers, news, and other Drumatica announcements.

Marketing emails include an unsubscribe mechanism. You may unsubscribe from promotional email communications at any time by using the unsubscribe link contained in those messages or by contacting us at:

info [at] drumatica [dot] com

Unsubscribing from promotional marketing emails does not prevent us from sending communications that are reasonably necessary to complete a transaction, deliver or administer a product, maintain a software license or registration, respond to a customer-support request, provide important product or security information, or otherwise service an existing customer relationship.

We honor applicable requests to stop or restrict marketing communications and other advertising-related uses of personal information.

6. Cookies, Analytics, and Advertising Technologies

Drumatica.com and service providers working with us may use cookies, pixels, tags, and similar technologies.

These technologies may help us:

  • Operate Drumatica.com
  • Maintain website functionality
  • Understand website traffic and customer interactions
  • Remember preferences
  • Analyze product and website performance
  • Measure marketing and advertising effectiveness
  • Understand how customers discover Drumatica
  • Attribute purchases or other activity to advertising campaigns
  • Deliver or improve relevant advertising

Depending upon the services being used, these technologies may involve providers such as Shopify, Google, Meta, email and customer-communication providers, and other website, analytics, and advertising services.

Information collected through these technologies may include device information, browser information, IP address, online identifiers, pages viewed, referring sources, advertisements viewed or clicked, and actions taken on Drumatica.com.

Where required by applicable law, we obtain consent before using nonessential cookies or similar technologies.

Available cookie and privacy preferences may be managed through Drumatica.com's privacy controls and through applicable browser or device settings.

7. Advertising, Customer Matching, and Similar Audiences

Imaginos LLC may advertise Drumatica® products through third-party advertising platforms, including Google, Facebook, and Instagram.

Subject to applicable law, appropriate notice, and applicable customer privacy choices, we may use certain customer information for advertising-related purposes.

This may include using information such as an email address, product ownership, purchase information, or website activity to:

  • Measure advertising performance
  • Understand whether an advertisement contributed to a website visit or purchase
  • Reach existing customers with relevant Drumatica advertising
  • Exclude existing customers from advertising for products they already own
  • Create advertising audiences consisting of Drumatica customers or product owners
  • Identify prospective customers who may have characteristics or interests similar to existing Drumatica customers or product owners

For certain advertising services, limited customer identifiers such as email addresses may be securely transformed, including through a process commonly known as hashing, before being transmitted to an advertising platform for matching.

Hashing does not necessarily make information anonymous to the receiving advertising service, and we treat these activities as uses of personal information subject to applicable privacy requirements.

Imaginos LLC does not intend to provide software serial numbers, complete payment-card information, or private customer-support correspondence to advertising platforms for customer matching.

Where applicable law requires consent, notice, an opportunity to object, or an opportunity to opt out of these activities, Imaginos LLC will provide the applicable mechanism and honor applicable customer choices.

8. How and When We Disclose Personal Information

Imaginos LLC may disclose personal information to service providers and business partners when reasonably necessary to operate Drumatica and provide our products and services.

These recipients may include:

  • Ecommerce providers
  • Payment processors
  • Digital-product delivery providers
  • Software licensing and activation providers
  • Website and technology providers
  • Email and customer-communication providers
  • Analytics providers
  • Advertising platforms
  • Customer-support services
  • Accountants, attorneys, and other professional advisers

We may also disclose information when reasonably necessary to comply with law, respond to valid legal process, investigate fraud, enforce our agreements, protect our customers, protect Imaginos LLC or Drumatica intellectual property, or defend our legal rights.

If Imaginos LLC is involved in a merger, acquisition, sale, restructuring, financing, or similar business transaction, information may be transferred as part of that transaction subject to applicable law.

Imaginos LLC does not sell customer email lists to data brokers.

Certain disclosures involving advertising or analytics providers may nevertheless be legally characterized as a "sale," "sharing," or use for "targeted advertising" under some privacy laws even when Imaginos LLC does not receive money in exchange for the information.

Where applicable, customers may exercise legally available rights to opt out of these activities.

9. Your Privacy Choices and Rights

Depending on where you reside and which privacy laws apply, you may have rights concerning your personal information.

These may include the right to:

  • Request access to personal information we maintain about you
  • Request correction of inaccurate personal information
  • Request deletion of eligible personal information
  • Obtain a copy of certain personal information
  • Withdraw consent where processing relies upon consent
  • Object to certain processing based upon legitimate interests where applicable

You may also use privacy or data-sharing controls made available through Drumatica.com where applicable.

We may need to verify your identity before completing certain requests.

We will respond to valid requests in accordance with applicable law and will not unlawfully discriminate against customers for exercising applicable privacy rights.

Certain information may need to be retained despite a deletion request when necessary for purposes such as transaction records, accounting and tax requirements, fraud prevention, software licensing, intellectual-property protection, dispute resolution, or other legal obligations.

10. Advertising and Marketing Opt-Outs

Customers may unsubscribe from promotional email through the unsubscribe mechanism contained in our marketing emails.

Where applicable privacy laws provide additional rights regarding targeted advertising, sharing, or other advertising uses of personal information, customers may exercise those rights through available Drumatica.com privacy controls or by contacting:

info [at] drumatica [dot] com

An email unsubscribe may apply specifically to promotional email. A customer who wishes to object more broadly to the use of personal information for targeted advertising, customer matching, or similar advertising purposes should indicate that in the request so that we can apply the request appropriately.

Where legally required, we also recognize applicable browser-based or device-based privacy preference signals.

11. International Customers

Imaginos LLC is based in Ohio, United States, and Drumatica serves customers in the United States and other countries.

Information may therefore be processed or stored in the United States or in other countries in which our service providers operate.

Where applicable law requires safeguards for international transfers of personal information, we and our service providers use appropriate mechanisms as required.

For individuals in the European Economic Area, United Kingdom, and other jurisdictions requiring a lawful basis for processing personal information, the applicable basis depends upon the processing activity.

Depending upon the circumstances, these bases may include:

  • Performance of a contract
  • Compliance with a legal obligation
  • Legitimate interests pursued by Imaginos LLC or another party, provided those interests are not overridden by applicable individual rights
  • Consent where required or where we otherwise choose to rely upon consent

Where we rely upon legitimate interests, those interests may include operating and improving Drumatica, supporting customers and registered products, protecting our products and business, understanding customer relationships, and promoting relevant Drumatica products, subject to applicable legal requirements and individual rights.

Where we rely upon consent, consent may be withdrawn as permitted by applicable law.

Customers may contact us to inquire about the basis applicable to a particular use of their personal information.

Where applicable, individuals may also have the right to lodge a complaint with the appropriate data-protection authority.

12. Data Retention

Imaginos LLC retains personal information for only as long as reasonably necessary for the purposes for which it was collected and for legitimate business, contractual, and legal purposes.

These purposes may include:

  • Maintaining purchase records
  • Maintaining software-license and product-registration records
  • Supporting registered Drumatica products
  • Providing customer service
  • Maintaining records of customer privacy choices
  • Accounting and tax obligations
  • Fraud prevention
  • Intellectual-property protection
  • Resolving disputes
  • Enforcing agreements
  • Complying with applicable law

Different categories of information may therefore be retained for different periods.

We may delete, anonymize, or restrict information when continued retention is no longer reasonably necessary or legally justified.

13. Information Security

Imaginos LLC uses reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

Access to customer information is limited to Imaginos LLC personnel and service providers with an appropriate business need for that information.

No method of transmission over the Internet or electronic-storage system can be guaranteed to be completely secure, and therefore we cannot guarantee absolute security.

14. Children's Privacy

Drumatica products are music-production products intended primarily for musicians, producers, engineers, creators, and other users of music-production software and content.

Drumatica.com is not directed to children under the age of 13, and Imaginos LLC does not knowingly collect personal information from children under 13.

If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take appropriate steps to delete that information as required by law.

15. Third-Party Websites and Services

Drumatica.com may contain links to retailers, social networks, music-industry websites, service providers, and other third-party websites or services.

Those services operate independently from Imaginos LLC and may maintain their own privacy practices.

This Privacy Policy does not govern information a third party collects independently from Drumatica.

We encourage customers to review the privacy policies of third-party services they use.

16. Changes to This Privacy Policy

Imaginos LLC may update this Privacy Policy periodically to reflect changes in Drumatica products, services, business operations, technology, service providers, or applicable legal requirements.

When we update this policy, we will revise the effective date shown at the top of the policy.

When required by applicable law, we will provide additional notice of material changes or obtain consent before applying a materially different use to personal information previously collected.

Publication of an updated Privacy Policy does not by itself retroactively establish that customers received notice of practices that were not disclosed to them at the time their information was originally collected.
