Terms of Service
Effective Date: October 10, 2026
Overview
This website is operated by Imaginos LLC, an Ohio limited liability company doing business under the registered Drumatica® trademark ("Imaginos," "Drumatica," "we," "us," or "our").
Imaginos LLC offers this website, Drumatica.com, including all information, tools, digital products, software, sample libraries, MIDI products, downloads, and services available through the website (collectively, the "Service"), conditioned upon your acceptance of the terms, conditions, policies, and notices stated here.
By visiting Drumatica.com, purchasing or registering a Drumatica® product, downloading digital content, or otherwise using the Service, you agree to be bound by these Terms of Service ("Terms"), including additional terms, policies, and conditions referenced herein or made available by hyperlink.
Please read these Terms carefully before accessing or using the Service. If you do not agree to these Terms, you should not access or use the Service.
Any new features, products, tools, or services added to Drumatica.com may also be subject to these Terms. We reserve the right to update or replace these Terms by posting an updated version on this page. Where required by applicable law, additional notice will be provided for material changes.
Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to sell our products and services.
1. Online Store Terms
By using the Service, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have any permission required under applicable law to use the Service.
You may not use our products or Service for any illegal or unauthorized purpose, nor may you violate applicable laws, including copyright and other intellectual-property laws, in connection with your use of the Service.
You must not transmit worms, viruses, malicious code, or other technology intended to damage, interfere with, or compromise the Service or any related website or system.
A material breach of these Terms may result in suspension or termination of your access to the Service.
2. General Conditions
We reserve the right to refuse or discontinue service where permitted by applicable law, including in cases involving suspected fraud, abuse, unauthorized resale, intellectual-property infringement, misuse of Drumatica products, or violation of these Terms.
You agree not to reproduce, duplicate, copy, sell, resell, distribute, sublicense, exploit, or commercially use any portion of the Service except as expressly permitted by Imaginos LLC or by the applicable license governing a Drumatica product.
The headings used in these Terms are included for convenience and do not limit or otherwise affect the interpretation of these Terms.
3. Accuracy, Completeness, and Timeliness of Information
We make reasonable efforts to provide accurate and current information on Drumatica.com. However, information made available through the website may occasionally contain errors, omissions, or outdated information.
Information on the site is provided for general informational purposes and should not necessarily be relied upon as the sole basis for decisions where more complete or current information is reasonably required.
Drumatica.com may contain historical information that is provided for reference. We reserve the right to modify website content at any time, subject to applicable legal obligations.
4. Modifications to Products, Services, and Prices
Prices for Drumatica products and services are subject to change without notice unless otherwise required by law.
We reserve the right to modify, update, replace, suspend, or discontinue a product or Service, or any part thereof, subject to applicable law and any contractual rights associated with purchases already made.
Product features, specifications, compatibility, included content, pricing, promotional offers, and availability may change over time.
5. Products and Services
Drumatica primarily sells digital music-production products, including software, downloadable audio samples, drum libraries, MIDI products, software-compatible files, and related digital content.
Because many Drumatica products are delivered digitally, purchases may be subject to specific refund limitations once files, software, serial numbers, license keys, or other digital content have been delivered, accessed, activated, or downloaded.
Please review our Refund Policy for the terms applicable to refunds and returns.
We make reasonable efforts to accurately describe our products, including product format, compatibility, included files, features, and other specifications. Product descriptions and pricing may be updated from time to time.
We reserve the right, where permitted by law, to limit the sale or availability of products or services to particular persons, geographic regions, or jurisdictions and to limit quantities purchased.
Any offer for a product or service is void where prohibited by law.
6. Digital Products, Software, and Licensing
Unless expressly stated otherwise, purchasing a Drumatica® digital product gives you a license to use that product subject to the license terms applicable to the product. A purchase does not transfer ownership of Drumatica intellectual property, recordings, software, samples, trademarks, copyrights, or other proprietary materials to you.
Individual Drumatica software products or downloadable products may be subject to an End User License Agreement ("EULA") or other product-specific license terms. Where a product-specific EULA or license applies, those terms are incorporated into these Terms by reference with respect to that product.
In the event of a conflict between these Terms and a product-specific EULA concerning permitted use of a licensed Drumatica product, the product-specific EULA will control with respect to that licensed product.
You are responsible for reviewing applicable product requirements and compatibility information before purchasing, including supported software, operating systems, host applications, samplers, plugin formats, and other technical requirements where applicable.
7. Accuracy of Billing and Account Information
We reserve the right to refuse or cancel an order where reasonably necessary, including orders that appear fraudulent, unauthorized, abusive, duplicative, intended for unauthorized resale, or otherwise inconsistent with these Terms.
Restrictions may include orders placed using the same customer account, payment method, billing information, or other identifying information.
If we change or cancel an order, we may attempt to notify you using the email address, telephone number, billing information, or other contact information provided with the order.
You agree to provide current, complete, and accurate purchase and account information and to update information when reasonably necessary so that we can complete transactions, deliver products, administer licenses, and contact you regarding your purchase.
8. Product Registration and Activation
Certain Drumatica products may require or permit product registration or activation. This may include products purchased directly from Drumatica.com as well as Drumatica products purchased from authorized third-party retailers or distributors.
Registration may require information such as your name, email address, product purchased, retailer or distributor, and product serial number or other proof of ownership.
Registration information may be used to verify ownership, administer software licenses, provide product support, maintain registration records, communicate important information regarding your product, and for other purposes described in our Privacy Policy.
Our collection and use of personal information, including information submitted through product registration, is governed by our Privacy Policy.
9. Optional Tools and Third-Party Services
We may provide access to third-party tools, platforms, software, payment services, digital-delivery services, or other technologies that we do not own or control.
Third-party services may be subject to their own terms and privacy policies. You should review the applicable terms before using third-party services.
We may introduce new services, integrations, tools, or features in the future. Unless otherwise stated, use of features offered through Drumatica.com will also be subject to these Terms.
10. Third-Party Links
Drumatica.com may contain links to third-party websites, services, retailers, social-media platforms, or other resources.
Third-party websites and services operate independently of Imaginos LLC. We are not responsible for the content, accuracy, privacy practices, products, services, or business practices of third parties.
Your interactions or transactions with a third party are subject to that third party's applicable terms and policies.
11. User Comments, Feedback, Reviews, and Submissions
If you submit comments, reviews, feedback, suggestions, ideas, testimonials, or other materials to us, you represent that you have the right to provide that material and that doing so does not violate the rights of another person or entity.
Unless otherwise agreed in writing or prohibited by applicable law, you grant Imaginos LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, and distribute feedback, reviews, comments, and other submissions you voluntarily provide in connection with Drumatica and its products.
You agree that submissions will not contain unlawful, defamatory, abusive, obscene, malicious, or infringing material, malware, or intentionally false or misleading information.
You may not impersonate another person, use a false identity to mislead us or other users, or misrepresent the origin of a submission.
12. Personal Information and Privacy
Your submission of personal information through Drumatica.com, including information submitted when purchasing, registering or activating a product, requesting support, subscribing to communications, or otherwise interacting with Drumatica, is governed by our Privacy Policy.
Our Privacy Policy describes the categories of personal information we collect, how we use and disclose that information, our use of cookies and advertising technologies, customer matching and similar-audience advertising, marketing communications, privacy choices, and rights that may be available under applicable law.
Where required by applicable law, we provide applicable mechanisms for consent, objection, withdrawal, or opt-out relating to particular uses of personal information.
13. Email Communications
We may send transactional or service-related email communications concerning purchases, downloads, product registration or activation, software licenses, product updates, compatibility, technical information, security, and customer support.
Where permitted by applicable law and consistent with applicable customer choices, we may also send marketing and promotional communications concerning Drumatica products, upgrades, new releases, related products, discounts, special offers, news, and announcements.
Promotional marketing emails include an unsubscribe mechanism. Unsubscribing from promotional marketing emails does not necessarily prevent us from sending transactional, licensing, product-registration, security, product-support, or other service-related communications reasonably necessary to administer an existing customer relationship.
Additional information concerning email communications and privacy choices is available in our Privacy Policy.
14. Errors, Inaccuracies, and Omissions
Occasionally information on Drumatica.com may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, compatibility, availability, or other product information.
We reserve the right to correct errors, inaccuracies, or omissions and to update information or cancel an affected order where appropriate and permitted by law.
15. Prohibited Uses
In addition to other restrictions contained in these Terms, you may not use Drumatica.com, the Service, or Drumatica content:
- For an unlawful purpose;
- To encourage or participate in unlawful activity;
- To violate applicable laws or regulations;
- To infringe or violate our intellectual-property rights or the rights of others;
- To harass, threaten, abuse, defame, or unlawfully discriminate against another person;
- To submit intentionally false or misleading information;
- To upload or transmit malware, viruses, or malicious code;
- To unlawfully collect, track, or misuse personal information;
- To spam, phish, pharm, pretext, scrape, crawl, or otherwise misuse the Service;
- To circumvent security, licensing, activation, download, or access-control features;
- To obtain, distribute, share, sublicense, or resell Drumatica products in violation of an applicable license; or
- To interfere with the operation or security of the Service.
We reserve the right to suspend or terminate access to the Service for violation of these restrictions.
16. Intellectual Property
Drumatica.com and the products, software, recordings, audio samples, graphics, text, designs, logos, trademarks, interfaces, documentation, and other materials made available through Drumatica are owned by or licensed to Imaginos LLC and are protected by applicable intellectual-property laws.
Drumatica® is a registered trademark of Imaginos LLC.
Except as expressly permitted under an applicable product license or EULA, nothing in these Terms grants you a right to reproduce, distribute, sell, sublicense, publicly distribute, commercially exploit, reverse engineer, or otherwise use Drumatica intellectual property.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, we do not guarantee that use of the Service will always be uninterrupted, timely, secure, or error-free.
Except for warranties that cannot lawfully be excluded or as expressly provided by Imaginos LLC in writing, the Service and products made available through the Service are provided "as is" and "as available."
To the maximum extent permitted by law, Imaginos LLC disclaims implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement where such disclaimers are legally permitted.
Nothing in these Terms excludes or limits consumer rights or warranties that cannot lawfully be excluded or limited.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Imaginos LLC and its officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from or relating to use of the Service or a Drumatica product.
Where applicable law does not permit particular exclusions or limitations of liability, those exclusions or limitations apply only to the maximum extent permitted by law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Imaginos LLC and its affiliates, officers, directors, employees, agents, contractors, licensors, service providers, and suppliers from third-party claims, liabilities, damages, and reasonable expenses arising from your material breach of these Terms, violation of applicable law, or infringement of the rights of another person or entity.
20. Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the maximum extent permitted by applicable law and the unenforceable portion will be considered severed from these Terms without affecting the validity and enforceability of the remaining provisions.
21. Termination
These Terms remain effective unless terminated by you or Imaginos LLC.
You may stop using the Service at any time. We may suspend or terminate access to the Service where reasonably necessary because of a violation of these Terms, suspected fraud or abuse, unauthorized use of our products, security concerns, or as otherwise permitted by applicable law.
Obligations and liabilities that by their nature should survive termination, including intellectual-property restrictions, payment obligations, limitations of liability, and applicable license restrictions, will survive termination.
22. Entire Agreement
These Terms, together with policies and product-specific agreements expressly incorporated by reference, constitute the agreement between you and Imaginos LLC concerning use of the Service, subject to any separate written agreement applicable to a particular product or transaction.
Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.
23. Governing Law
These Terms of Service and any separate agreements through which Imaginos LLC provides products or services will be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict-of-law principles, except to the extent that applicable consumer-protection law requires otherwise.
24. Changes to These Terms

We reserve the right to update, change, or replace portions of these Terms by posting an updated version to Drumatica.com. The effective date at the top of this page will identify the date of the current version.
Where required by applicable law, we will provide additional notice regarding material changes.
